Law Enforcement Guidelines

These guidelines explain how law enforcement and other government authorities may seek information from Sequesign Inc. and how Sequesign responds to legal process. They are intended to assist legitimate investigations while protecting the rights of our customers and users. They are not legal advice and do not waive any legal objection or requirement.

1. Information Sequesign holds

Sequesign operates a cryptographic receipt, witness, and audit-trail platform. Depending on the customer’s configuration, Sequesign may hold account and contact information, receipt metadata, witness log entries, billing records, operational and security logs, and, where hosted evidence storage is enabled, evidence content. In the default hash-only mode, Sequesign does not hold the underlying evidence content and stores only cryptographic hashes and metadata. Sequesign can only produce data that it actually holds and retains under its retention practices.

2. Required legal process

Sequesign requires valid legal process appropriate to the data sought, consistent with the Stored Communications Act and other applicable law:

Subpoena Basic account and subscriber information, such as account identifiers, contact details, and billing references
Court order Non-content records and other information as specified by the order
Search warrant Content, including hosted evidence content where it is stored, based on probable cause

Sequesign reviews each request for legal sufficiency and may object to or seek to narrow requests that are overbroad, vague, or legally deficient.

3. Preservation requests

Sequesign will honor valid preservation requests under 18 U.S.C. § 2703(f) to preserve records it holds for 90 days, extendable for an additional 90 days on renewed request, pending service of valid legal process. A preservation request should identify the relevant account and data with reasonable specificity.

4. Emergency requests

In emergencies involving a danger of death or serious physical injury, Sequesign may voluntarily disclose information to law enforcement where it has a good-faith belief that disclosure is necessary to prevent the emergency, consistent with applicable law. Emergency requests should be submitted using a recognized emergency disclosure request that describes the nature of the emergency and the specific information needed.

5. How to submit requests

Legal process and law-enforcement requests should be directed to legal@sequesign.com. Requests should identify the account or data with reasonable specificity, identify the issuing authority and matter, and provide a return contact. Sequesign verifies the authenticity of requests before responding.

6. Notice to customers

Sequesign’s policy is to notify affected customers or users of requests for their information where permitted by law and reasonably practicable, so that they may seek to protect their interests. Sequesign may delay or withhold notice where prohibited by law or court order, where notice could endanger an individual or an investigation, or in genuine emergencies.

7. Authentication, cost, and format

Sequesign may take reasonable steps to verify the legitimacy of a request and the identity of the requester. Where permitted by law, Sequesign may seek reimbursement of reasonable costs of responding. Sequesign produces responsive data in a reasonable electronic format.

8. Requests from outside the United States

Sequesign is established in the United States. Requests from authorities outside the United States should generally be made through applicable legal channels, such as a mutual legal assistance treaty, letters rogatory, or another recognized mechanism, unless an applicable agreement provides otherwise.

9. Child safety

Matters involving apparent child sexual abuse material are handled under our Child Safety Policy and applicable law, including mandatory reporting and preservation obligations.
